The City of Toulon has initiated a process to consolidate its relationships with real estate management professionals. On Wednesday, October 7, a meeting took place at the Town Hall, gathering about thirty condominium trustees from the Toulon area. This meeting, led by Serge Lhotellier, deputy mayor responsible for housing safety, aimed to foster exchanges between the community and housing stakeholders, who face common challenges in building safety.
The initiative seeks to better understand each party's constraints, streamline information flow, and simplify the processing of files requiring municipal intervention. Improved coordination among stakeholders should lead to more effective monitoring of risky situations for occupants and reduce procedural risks.
During this first meeting, Serge Lhotellier and his teams recalled the regulatory framework governing municipal interventions, particularly the Code de la construction et de l’habitation (Building and Housing Code) and the Code général des collectivités territoriales (General Code of Local Authorities). This educational reminder helped differentiate the mayor's general police powers, exercised in cases of immediate danger, from their special police powers dedicated to housing safety and sanitation, which address structural issues, lack of maintenance, or fire and unsanitary risks.
The meeting also highlighted the gradation of disorders, ranging from simple non-decency to unsanitary conditions (under the Prefect's jurisdiction) and buildings at risk of collapse (directly under the Mayor's purview). Discussions detailed each party's responsibilities, emphasizing the trustee's central role as both 'pilot' and 'facilitator'.
Beyond procedural reminders, discussions underscored the trustee's key role in facilitating access and information, managing general assemblies, handling fund calls, overseeing construction sites, and ensuring traceability of actions. Trustees also provide proof of information to occupants and organize administrative steps for resolving issues.
